In compliance with the provisions of Law 34/2002 of 11 July, on The Information Society and e-commerce services, and applicable regulations, IMAGINARIUM S.A. informs you that:

Contract authority

When acquiring the services offered by Imaginarium, S.A., purchasers must be authorised to enter into contracts according to the laws of their country.

Purpose of the contract

The purpose of this contract is the sale of products and services for children and their families. Their specifications are given on the corresponding pages of this website, as well as the details of each transaction that is performed in this environment.

Identification of supplier

The supplier of the products and services contracted by users is Imaginarium, S.A., with registered office at Plataforma Logística de Zaragoza - C/ Osca, no. 4 - 50197 Zaragoza (Spain) and Spanish Tax Number (CIF) A50524727. It is registered in the Zaragoza Companies Register under volume 1,304, folio 8, section Z-7250, entry 1. Imaginarium, S.A. is registered in the Treasury's Registry of Distance Selling Companies under number NEVA-2007/0740/02/50/9/V, pursuant to the provisions of Royal Decree 225/2006 of 24 February.

Completing and sending the order form is considered as acceptance of the terms of the contract, and under no circumstances shall it be considered as a commercial proposal. Imaginarium, S.A. is registered in the Treasury's Registry of Distance Selling Companies, number -NEVA-2007/0740/02/50/9/V, in compliance with Royal Decree 225/2006, 3 February. Completing and sending the order form is considered as acceptance of the terms of the contract, and under no circumstances shall it be considered as a commercial proposal.

Order delivery

Orders shall be delivered by Imaginarium, S.A., either using its own resources or a transport agent designated by it. Orders shall be delivered to the address and with a card bearing the text given by the purchaser, and therefore, Imaginarium, S.A. shall not be held liable for non-delivery due to inaccurate or incomplete information or absence of the recipient. Notwithstanding the above, Imaginarium, S.A. will take the measures required of diligent retailers to make the delivery as soon as possible and to the satisfaction of both sender and recipient. When deliveries are to hospitals, public organisations or other buildings where public access is restricted, Imaginarium, S.A. does not guarantee direct delivery to the recipient, such delivery being completed, with release from all liability, when the order has been placed at the disposition of the recipient at the reception desk or other access control point.
Imaginarium, S.A. guarantees order delivery within the deadlines shown in the corresponding section of the website for the transport system and destination chosen by the purchaser. The order collection and delivery service is unavailable on Saturdays, Sundays and bank holidays. This fact must be taken into account when calculating delivery dates. During periods in which there are special circumstances (special dates such as Christmas, transport strikes, unexpected events, etc.), deliveries may be delayed. Imaginarium, S.A. does not guarantee delivery at specific times. If the purchaser indicates a specific delivery date or, on that date, indicates a preference for a particular time of day, this will be taken as a guideline only. Imaginarium, S.A. shall communicate this circumstance to the carrier so that, insofar as possible, these instructions are followed, without any obligation to do so or liability in this respect.

The products and services acquired through the www.descargasimaginarium.es portal shall be downloaded directly by purchasers on their personal electronic devices, after they have been duly informed that proper use may require specific software and hardware and preferably high-speed connection to the internet. Imaginarium accepts no liability for deficient use of the products due to lack of software, hardware or other requirements, or for any interruptions not attributable to Imaginarium that may occur while downloading.

Price and offer validity period

The prices shown under each product are the total (VAT included) and only shipping costs need be added as specified for each destination and shipping option selected. Prices are shown in euro. The prices and conditions shown are valid when published, and remain in effect only for the duration of the session in progress. In the order confirmation information given before the purchaser accepts the transaction the prices of each of the articles selected, the additional cost of delivery applicable to the transaction and any special offers or discounts, if applicable, are clearly specified.

As you will see, when you order through the web, the corresponding invoice is sent to the e-mail address you give us and accompanies the products ordered. Right to cancellation

Imaginarium wishes to offer you the best possible service. Therefore, you may return any product acquired with home delivery by contacting us at the Guest Attention Service on 902 214 215 or at imaginarium@imaginarium.es, but bear in mind that the cost of such return is at your own expense (pursuant to current regulations). In any case, you must keep the product and its original packaging in perfect condition.

This right to cancellation shall not be applicable to those products acquired through the www.imaginarium.ie portal, www.descargasimaginarium.es or other distance selling method that, pursuant to legislation, are not subject to cancellation due to the fact that they are digital content downloads, sound recordings, videos, CDs and similar, or personalised products, or for reasons of hygiene or other exceptions legally provided for.

Intellectual Property and Other Rights

Purchasers acknowledge and accept that the items and intellectual property, industrial or other rights (including, without limitation, any copyright, patents, trademarks, designs, photographs, pictures and source codes) related to the Imaginarium Group web platforms to which they may have access are the exclusive property of Imaginarium, S.A. Imaginarium manages and maintains its download platform in collaboration with the German Imaginarium Group company, Family Net GmbH. Purchasers may not, directly or indirectly, copy, change, alter, publish, communicate, distribute, sell or transfer the materials on this platform or its source code, or the downloads performed, either in their entirety or in part, without written authorisation from Imaginarium, S.A.

Imaginarium informs that the MP3 products we offer carry the digital seal of the Frauenhofer Institute (Munich, Germany). This digital seal is automatically entered at the time of download, and allows us to identify the purchaser by means of a numeric code, which is at all times associated with the product, even when the download is copied or saved onto a CD. It is a protection measure against any illegal action that could affect the download and contains information on the owner of the rights. In no case does this seal contain personal information about the purchaser, who is for all purposes the end user. With the use of this device, Imaginarium seeks to give its support to our authors, artists and all purchasers of legal downloads.

Applicable legislation and legal jurisdiction

Anything not specifically covered in these General Conditions shall be governed and interpreted pursuant to Spanish legislation. The parties, expressly renouncing any other jurisdiction that may apply, accept, except in cases in which it is not legally permitted, the jurisdiction and authority of the Courts of the city of Zaragoza (Spain) for the resolution of any issues that may arise between them.

Imaginarium we believe in quality, even before the toys leave the factories. All products pass through strict safety controls, to guarantee that the materials, manufacturing processes and selection meet all European standards. Our goal is that the toys reach your hands as soon as possible, and in perfect condition. For this reason, we have a logistics platform that specialises in children's products. We want to offer you the best service possible. For this reason, you can return any of our products by contacting us through the Customer Service Line by writing to imaginarium@imaginarium.es . We will answer any questions you may have about your order, arrange to pick up the product at your home free of charge, and either give you another product in exchange or give you a refund. Remember, however, that you must keep the original packaging in perfect condition. Remember that all returns must be processed within 1 month of the purchase, and the sales receipt must be presented. Personal hygiene products, CDs or software that have been opened and other products that, due to their nature, cannot be returned, will not be accepted for return.
